Builder PAYG & Territory Lease Terms

Draft commercial terms — version 2026-09-04-v1. Have New Zealand commercial counsel review this document before launch.

1. PAYG lead

A PAYG purchase provides exclusive platform access to the contact and project information submitted by the homeowner for that lead. It is a sales opportunity, not a guaranteed job, appointment, quote request, building contract or revenue outcome.

2. No conversion guarantee

Granny Flat Quotes does not guarantee that a homeowner will answer communications, remain interested, obtain finance or approvals, proceed with a project, accept a quotation, enter a contract, or purchase services. The builder is responsible for follow-up, assessment, pricing, sales and conversion.

3. Non-refundable non-conversion

A lead is not refundable merely because the homeowner is unresponsive, changes plans, delays the project, cannot obtain finance, chooses another provider, rejects a quote, or the builder otherwise fails to win the work.

4. Qualification

“Qualified” means the enquiry satisfied the platform's stated qualification rules at submission. Unless expressly stated, Granny Flat Quotes does not independently verify every homeowner statement, including ownership, budget, finance, site feasibility, approvals or future intentions.

5. Platform errors

If the platform charges for a lead but materially fails to deliver the access purchased, duplicates an exclusive sale through a platform error, or makes a billing error, Granny Flat Quotes may correct the delivery or billing issue. This is separate from non-conversion risk.

6. Territory leases

A monthly lease provides exclusive routing of qualifying enquiries generated within the defined territory while active. Lead volume varies. No minimum lead or job volume is guaranteed unless expressly agreed in writing.

7. Business purpose

The builder confirms it is in trade and acquires the services for business purposes. To the extent permitted by New Zealand law and where fair and reasonable, the parties intend applicable business-to-business contracting-out provisions to apply.

8. Non-excludable law

Nothing excludes or limits a right, remedy or obligation that cannot lawfully be excluded.

9. Privacy

Lead information is supplied only for responding to the relevant homeowner enquiry. Builders must protect personal information, restrict access, comply with applicable privacy law, and must not resell or republish homeowner data.

10. Suspension

Accounts may be suspended for misuse of personal information, abusive conduct, circumvention, chargeback abuse, unauthorised access or material breach.
